Abstract: The perfection of the legislation is the basis of the comprehensive lawbased governance. It is necessary to obtain the right of local legislation for cities with subordinate districts. The Legislation Act has been revised accordingly, which has an important significance. However, there are still many problems to undertake the local legislative power at present. To achieve the scientific implementation of local legislation, we must complete the undertaking of local legislative power in city with subordinate districts through the multi channel way, and then realize the positive interaction between the rule of law and reform, which can also make local contributions to the implementation of comprehensive lawbased governance.

摘要： 健全的立法是实现全面依法治国的基础，设区市地方立法权的获得有着其必要性，《立法法》修改后赋予设区市地方立法权是社会发展、法治和国情的需要。当前设区市在承接地方立法权时还存在立法能力亟待提高、立法监督不足等问题。通过立法联勤保障、完善立法监督、破除立法利益化、多方参与开门立法、建立立法责任制度等做好设区市地方立法权的承接，达到设区市地方立法的科学化，做到法治与改革的良性互动，为全面依法治国的落实做出贡献。
