Abstract: The mistranslation of legal term results from the capacity of the translator, such as misspelling, miscomprehension, being wronglychosen among similar meaning terms. In addition, improper choosing translating strategy and the difference between legal cultures also can lead to mistranslation. On the basis of analyzing some examples, some related solutions are suggested, such as, improving the translators language proficiency, choosing the proper translating strategies, and deeply understanding cultures of legal English and legal Chinese.

摘要： 法律术语误译产生的原因主要是译者语言水平有限，表现在拼写错误、理解不当、词义近似而致选择性错误；翻译策略选择不当和法律文化差异也会导致误译。本文在实例分析的基础上对不同类别的误译提出了相应的应对之策：提高译者语言水平，选择适当的翻译策略，以及深谙英汉法律文化。
