摘要/Abstract

摘要： 公安机关查验身份证的执法活动涉及到查验对象、执法民警、社会公众的三方人权。在身份证查验的执法活动中，存在“假警察”语境下的便衣查验困境、“假证件”语境下的不让查验困境，容易引发一定程度的警民冲突。在深化公安执法规范化建设的背景下，需要构建公安民警规范查验模式，打造查验程序阳光警务模式，完善查验对象权利救济机制，进一步加强身份证查验执法活动中的人权保障。

Abstract: The public security organ involves in the objects of law enforcement, police officers and the general public in the ID card inspection, in which, the plainclothes police may be identified as fake police, the police ID card may be identified as invalid in implementation, which may cause the conflict between police officers and the general public at some certain level. Under the background of deepening the construction of public security law enforcement standardization, only through constructing the standard model of the ID card inspection, building the publicity of policing system and perfecting the right relief mechanism of the examinees, can the human rights involving in the ID card inspection be largely enhanced.
