海南集体建设用地参与旅游项目开发的法律分析

Abstract: Collective construction land is an important asset in rural areas. Rural collective construction land transfer is the trend of the market for land reform. Hainan conducts a pilot project of collective construction land involved in tourism development, and needs to break through the legal barriers of collective land entering the market, clear collective construction land ownership subject, enhance the collective construction land disposition, clear the direction of collective ownership, standardize cadastral management, establish the market access system of collective construction land, determine the development mode, reasonably distribute the profits of land, and improve the collective land tourism project development support measures.

摘要: 集体建设用地是农村的重要财富,农村集体建设用地入市流转是土地改革的大趋势。海南进行集体建设用地参与旅游项目开发试点,需要突破集体土地入市的法律障碍,明确集体建设用地所有权主体,增强集体建设用地的处分权能,明确集体所有权的发展方向,规范地籍管理,建立集体建设用地入市的准入制度,确定开发方式,合理分配土地收益,完善集体土地旅游项目开发的配套措施。
