Abstract: The Outline of Building a Powerful Transportation Country requires that road administration be modernized. Highway administration belongs to the concrete embodiment and effective extension of national administration in highway undertakings. The legalization of highway administration is the only way to realize the modernization of highway administration. This paper sums up the historical experience and lessons of the highway administration and its legalization through the induction and analysis of the highway administration and its legalization construction in the past seventy years in New China. In order to explore the legal context of highway property protection and right of way maintenance, we explore the construction of a powerful traffic country and provide legal advice for the modernization of highway administration management system and governance capacity.

摘要： 我国《交通强国建设纲要》要求路政管理必须现代化。路政管理属于国家行政管理在公路事业中的具体体现与有效延伸，公路路政管理的法治化是实现公路路政管理现代化的必由之路。归纳分析我国七十年来公路路政管理及其法治化建设轨迹，概括公路路政管理及其法治化的历史经验与教训，以期发掘路产保护与路权维护的法治脉络，探索在交通强国建设进程中为路政管理治理体系与治理能力的现代化提供法治化建议。
