Abstract: The efforts to reduce the arrest rate has achieved initial success, but the number after arrest cases without substantial punishment decision of prison still occupy a higher proportion. Objectively speaking, the quality of the arrests is due to many factors, such as the evidence change and differences between the reviews. But the deviation from arrest requirements, the contempt for the protection of the rights, the old evidence review mode and the absence of alternative measures to arrest are also indisputable facts. Prosecutors should, strictly follow the arrest requirements, update the concepts, improve the supporting measures, to further improve the level of arrest examination.
